Description

In relation to the case law guidance system introduced by the Supreme People's Court in 2010, this book identifies the legal nature of guiding provincial cases as an absolute reference that must be consulted in future trials concerning similar cases, serving as a guideline for the interpretation and application of laws. To this end, the legal nature of guiding provincial cases was examined through comparative analysis with our own judgments and precedents, precedents of the Anglo-American legal system, and Chinese judicial interpretations, while supporting theoretical arguments through empirical research. This book uniquely illuminates the developmental trajectory of the system by comparing the case law guidance system with Korea's case law system in addition to the common law system of the Anglo-American legal system, and by identifying the guiding power of guiding provincial cases based on an examination of the referential force of Korean precedents. Furthermore, it demonstrates how guiding provincial cases are cited in future trials across various fields, presents clear grounds for their production, and verifies their influence. At the very least, through this book, it is hoped that the Guidance and Censorship will be considered essential as a standard for resolving future disputes between Korea and China, thereby enabling our citizens to avoid problematic situations that may arise in exchanges with China in advance and increase the predictability of dispute outcomes in similar cases.
